Terms & Conditions
The agreement between you and Maven Concepts when you book through this site, and the line between what we are responsible for and what the operator is.
Effective August 14, 2026 · Rhythms of the Night Vallarta · Maven Concepts
1. Identity of the booking business and operator
Rhythms-of-the-Night-Vallarta.com (the “Site”) is an independent booking website operated by Maven Concepts, an Idaho-registered business partnership (“Maven Concepts,” “we,” “us”). The Site is not the official corporate website of Vallarta Adventures or The Adventures Group. Rhythms of the Night, including the ALMA performance and associated transport and hospitality, is operated and fulfilled by Vallarta Adventures / The Adventures Group (“Operator”). We market the experience, take reservation requests and payments, and arrange the booking with the Operator. Names and marks belonging to the Operator remain the property of their respective owners.
These terms apply to bookings requested through this Site. Material booking particulars provided in a customer’s confirmation — date, package, guest count, departure point and any stated restrictions — form part of the transaction. If an applicable mandatory consumer protection law grants a right that these terms do not, the mandatory right controls.
2. Reservation request versus confirmed reservation
Selecting a date, package and party size and paying through the Site creates a reservation request, not an instantly confirmed seat. No inventory is reserved until we obtain Operator confirmation and issue a confirmation with a reservation number. We generally contact customers within approximately 30 minutes during our posted support hours (Monday to Saturday, 7 am – 7:45 pm Puerto Vallarta time), or the next business morning; response times are estimates, not guarantees.
If the requested date or package cannot be confirmed, we will offer available alternatives or a full refund of the amount paid to Maven Concepts, at the customer’s choice. No substitute date or package will be imposed without consent. Customers must not treat an automated payment receipt alone as a confirmed ticket.
3. Prices, currencies and separate pier fees
The checkout displays the package price and the currency charged before purchase. Published prices may change before checkout and availability may change before Operator confirmation. Any legally required taxes, mandatory charges collected by us, or currency conversion information are disclosed at checkout as applicable.
A separate port-access charge is collected by the Operator at the pier: $20 per adult and $10 per child. This fee is not collected by Maven Concepts and is not included in the Site purchase total; the Operator may change it. Any bank, issuer or foreign-exchange fees charged independently by a customer’s financial provider are outside our control.
4. Payment processing and authorization
Payments are processed through Stripe. By submitting a reservation request, the purchaser authorizes the displayed charge. Card details are entered on Stripe-hosted payment pages; we do not store complete payment-card numbers or security codes on our servers. We receive payment confirmations, transaction references, card brand and last four digits, billing details, dispute information and fraud indicators as needed to administer the purchase.
A completed charge does not override the requirement for Operator confirmation. We reserve the right to reject or refer suspicious transactions for verification and to refund an unconfirmed request rather than issue a booking.
5. Customer-provided information and communications
The purchaser is responsible for accurate names, contact information, date, package, party size, ages and any information requested for the reservation. Customers must review the issued confirmation promptly and notify us of a discrepancy as soon as possible. We may contact the purchaser by email, telephone or text about payment, confirmation, tour logistics, schedule changes, refund processing or customer support; promotional messages are governed by applicable consent and opt-out requirements.
To fulfill a reservation we transmit the necessary guest and itinerary information to the Operator, who may contact or identify passengers as needed for check-in and delivery.
6. Cancellation, no-show and non-refundable purchases
Customer-initiated cancellations are non-refundable from the time of payment, including changes of travel plans, failure to arrive, late arrival or missed departure, consistent with the Operator’s published booking rules. Please review the booking date and departure details before paying. Exceptions apply where this policy expressly grants a refund, where the Operator authorizes one, or where applicable law requires one.
An unconfirmed reservation request that cannot be fulfilled on the requested terms qualifies for a full refund or a voluntarily accepted alternative. This policy does not limit rights arising from a duplicate or unauthorized charge, a failure by us to provide the contracted reservation, or another non-waivable legal remedy.
7. Date and package changes
Customers may request an amendment through our support channels. A requested date or package change is not effective unless the Operator approves it and we issue an updated confirmation. Changes depend on availability and may require payment of any applicable price difference, including special-event pricing. We do not impose a separate Maven Concepts change fee for an approved change; any Operator-imposed charges are disclosed before the customer agrees.
8. Operator cancellations and material changes
The Operator may cancel, postpone or materially alter a sailing or show for weather, maritime safety, operational conditions, regulatory orders or similar reasons. Where the Operator cancels the booked departure and no comparable service is provided, we will offer rebooking or a full refund of the amount collected by us for that booking, at the customer’s election, subject to mandatory law. We communicate material changes as soon as practical after learning of them.
Outdoor performances and maritime schedules are weather-dependent; light rain does not necessarily result in cancellation. Minor itinerary or menu substitutions do not automatically create a refund entitlement unless they materially change the purchased service or applicable law says otherwise.
9. Departure, arrival, age and suitability
The customer must follow the departure location and check-in time stated on the confirmed reservation; arrival at the wrong marina or after boarding closes may result in loss of the booking without refund. Departures are normally at 5:30 PM, monday to saturday — there is no Sunday sailing — with check-in at least 45 minutes beforehand. The confirmation takes precedence, because schedules may change.
Children under 6 are not admitted; ages 6–11 use child pricing and ages 12 and older use adult pricing. Natural terrain, sand, stairs, slopes, dim lighting, marine transfers and weather conditions may make the experience unsuitable for some guests, including guests with limited mobility. Customers should ask about accommodation needs before purchasing. The Operator determines actual boarding and safety eligibility consistent with law.
10. Independent provider and responsibility allocation
Maven Concepts is responsible for its own representations, payment collection, customer communications, arranging the requested reservation and administering refunds owed through our checkout. The Operator controls and delivers vessel operations, venue conditions, food and beverage service, staffing, passenger safety protocols and the performance. Each party remains responsible for its own conduct and legal duties; nothing here excludes liability that cannot legally be excluded.
Our role as an independent booking intermediary must not be confused with ownership or direct operation of the experience. Promotional imagery, menus and itinerary descriptions are provided for orientation and can change, subject to the actual purchased package and the Operator’s confirmed terms.
11. Refund timing, disputes and chargebacks
Approved refunds are directed to the original payment method where practical. Bank and card-network posting times vary; a refund initiated by us may not appear immediately. Contact us promptly with the booking reference and a description of the issue so we can investigate and coordinate with the Operator. Nothing in these terms restricts a customer’s right to dispute a charge with their payment provider or exercise statutory rights.
We retain relevant booking, payment and communication records to investigate fraud, resolve disputes, satisfy accounting obligations and comply with applicable law, as described in our Privacy Policy.
Those records include a technical record of the purchase itself: the IP address the reservation request was submitted from, the approximate location derived from it, the date and time of submission, and — where the purchase was made after an acknowledgement was presented at checkout — the exact wording shown, its version, and the time it was accepted. Where a charge is disputed, we may submit these records, together with transaction and email delivery records, to our payment processor and the relevant card network as evidence of the purchase and of the terms applicable to it.
12. Website use, accuracy and intellectual property
Users may access this Site to obtain tour information and make lawful reservations. Automated scraping that burdens the Site, fraudulent orders, misleading use of brands, impersonation and unauthorized interference with payment or booking systems are prohibited. Text, original site design and original materials are protected by applicable intellectual property law; Operator-provided brands and imagery remain subject to the rights of their owners.
We aim for accurate descriptions, but information should be read alongside the checkout, the official confirmation and current Operator requirements. Corrections may be made to obvious errors before booking confirmation; if a material error prevents fulfillment of the request as purchased, the customer will be offered a suitable alternative or refund.
13. Liability and mandatory consumer rights
To the fullest extent permitted by applicable law, Maven Concepts is not responsible for independent acts or omissions of the Operator, extreme weather, third-party transportation arranged by guests, or personal expenses unrelated to the booked service. This does not excuse our responsibility for our own negligence, misconduct, payment or refund obligations, or inaccurate statements, nor does it limit rights or remedies that cannot legally be waived.
Any limitation of liability, forum selection or dispute resolution arrangement must comply with applicable consumer law in the customer’s jurisdiction. We do not impose binding arbitration or an absolute waiver of claims through these terms.
14. Privacy, changes and contact
Personal information is handled under our separate Privacy Policy. The Booking Terms accepted at checkout set out the cancellation and date-change position in short form and form part of your purchase. We may revise these terms prospectively by posting a new version and effective date. The terms presented at the time of purchase govern that transaction, except where changes are required by law or expressly accepted.
